Subject: Ordinance amending Section 22-227 and 22-229 of the Code of Ordinances pertaining to pollution abatement charges and establishing a new rate schedule for pollution abatement charges.
Staff Recommendation:
Staff recommends approval of the ordinance establishing a rates schedule for pollution abatement.
Analysis:
The result of the recent utility rate study was presented to City of Leesburg Commission in a workshop on January 22, 2008. This rate ordinance reflects the data presented during that workshop.
Options:
1. Approve the Ordinance as presented, or,
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
As presented and discussed during the January 22, 2008 workshop, the intent of this rate redesign is that the proposed rate structure will be revenue neutral. Therefore, staff anticipates the proposed rate structure will have no significant effect on revenue.

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, AMENDING SECTION 22-227 OF THE CODE OF ORDINANCES PERTAINING TO POLLUTION ABATEMENT CHARGES; ESTABLISHING NEW RATE SCHEDULES FOR POLLUTION ABATEMENT CHARGES; PROVIDING FOR RATES EFFECTIVE MARCH 1, 2008; PROVIDING NEW PROPOSED BLOCK RATES; PROVIDING FOR RATES INSIDE AND OUTSIDE CITY LIMITS; REPEALING SECTION 22-229 OF THE CODE OF ORDINANCES OF THE CITY OF LEESBURG; RENUMBERING SECTIONS FOLLOWING SECTION 22-229 TO ACCOUNT FOR THE REPEAL OF SAID SECTION; PROVIDING FOR CONFLICTS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
SECTION 1.
Section 22-227, of the Code of Ordinances of the City of Leesburg, Florida, is hereby amended in its entirety to read as:

SECTION 2.
All ordinances or part of ordinances which are in conflict with this Ordinance are hereby repealed, to the extent necessary to alleviate the conflict, but shall continue in effect insofar as they are not in conflict herewith, unless repeal of the conflicting portion destroys the overall intent and effect of any of the conflicting ordinance, in which case those ordinances so affected shall be hereby repealed in their entirety.
SECTION 3.
Section 22-229 of the Code of Ordinances of the City of Leesburg, Florida, pertaining to billing charges in absence of other utilities, is hereby repealed in its entirety. Sections of the ordinance following this repealed section shall be renumbered accordingly.
SECTION 4.
If any portion of this Ordinance is declared invalid or unenforceable, and to the extent that it is possible to do so without destroying the overall intent and effect of this Ordinance, the portion deemed invalid or unenforceable shall be severed herefrom and the remainder of the ordinance shall continue in full force and effect as if it were enacted without including the portion found to be invalid or unenforceable.
SECTION 5.
This Ordinance shall become effective upon its passage and adoption according to law.
PASSED AND ADOPTED at the regular meeting of the City Commission of the City of Leesburg, Florida, held on the ______ day of ______________, 2008.
