Subject: Resolution Adopting the Amended Planning and Zoning Fees
Staff Recommendation:
Staff recommends approval of the proposed amended fees (Exhibit A). The following proposed fee schedule represents an adjustment to current fees and the addition of fees for fifteen applications currently being processed at no charge. The proposed fees represent the average fees for processing comparable applications by local cities and others within the Central Florida area.
Background:
The City of Leesburg Commission adopted the current Land Development Code fees by resolution in August, 1997. In the last ten years or more,, there has been a significant increase in development activity and expansion of the City due to annexations. Work was completed on a new Comprehensive Plan for the City in 2003 and a new Land Development Code was adopted in July 2004 in order to provide for quality growth and preserve the character and heritage of Leesburg. New Land Use categories such as Conservation, Estate and Downtown Mixed Use have been developed. In addition, new Zoning Districts such as PUD (Planned Unit Development), CBD (Central Business District) and RP (Residential Professional) have been implemented. All of these actions have resulted in better development within the City. During this ten year time period the cost of doing business has increased, but the fees to cover those costs have not; therefore the City Manager requested a review of our fees.
Analysis:
Staff’s approach to the analysis was to obtain fee schedules from various cities in the central Florida area that were similar to Leesburg in the services they provided. Seven of those cities were located in Lake County. The selected cities for the analysis have revised their fees within the last seven years. Staff selected and reviewed seventeen local governments’ current fees in addition to Leesburg’s fees and developed an Excel spread sheet to compare thirty-three fees for each jurisdiction. In addition, Lake County fees were reviewed as well. Some adjustments to the various fees from other jurisdictions were necessary for comparison purposes due to differences in fee calculation methods. Also, information was gathered for each jurisdiction indicating their population and size in square miles. Once fees were reviewed, staff decided to eliminate the jurisdictions with the highest and lowest fees in order not to skew the results. The final analysis included Lake County and eleven cities. The fees for the selected cities were averaged and compared to the fees for City of Leesburg and Lake County. Based on the results of this analysis, the staff developed a recommended draft fee schedule for review by city administration and consideration by the City Commission. To illustrate the proposed fees, staff developed the attached bar graphs and applied the proposed fees to various types of actual projects in the city. The projects compare the current, proposed, county and average fee from the survey to each project.
Options:
1. Approve the resolution for the revised fee schedule.
2. Disapprove the resolution for the revised fee schedule.
Fiscal Impact
Approval of the proposed Fee Schedule will increase the revenues generated by the Planning and Zoning Division and offset a portion of the cost to process applications.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, ADOPTING AMENDED FEES FOR APPLICATIONS FOR REZONING, CONDITIONAL USE, ANNEXATION, VARIANCE, PLANNED UNIT DEVELOPMENT, VACATING, PLAT APPROVAL, ZONING ORDINANCE AMENDMENT, COMPREHENSIVE PLAN AMENDMENT, CONSTRUCTION PLAN APPROVAL, PRELIMINARY SUBDIVISION REVIEW, SITE PLAN REVIEW, D.R.I., LOT SPLIT, MINOR SUBDIVISION, LIMITED USE PERMIT, ZONING WRITTEN VERIFICATION, TREE REMOVAL PERMIT, ALCOHOL/BEVERAGE LICENSE REVIEW, TRAFFIC STUDY REVIEW, HISTORIC APPLICATION REVIEW, SPECIAL EVENT PERMIT ADMINISTRATIVE APPEAL AND REPEALING THE EXISTING FEE SCHEDULE ADOPTED VIA RESOLUTION NO. 5220; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, certain fees are necessary for processing of applications for rezoning, conditional uses, annexation, variance, planned unit development, vacating, plat approval, zoning ordinance amendment, comprehensive plan amendment, construction plan approval, preliminary subdivision review, site plan review, D.R.I., lot split, minor subdivision, limited use permit, zoning written verification, tree removal permit, alcohol/beverage license review, traffic study review, historic application review, special event permit, administrative appeal in conjunction with Chapter 25 of the Code of Ordinances of the City of Leesburg, and
WHEREAS, Article VIII of Chapter 25 of the Code of Ordinances of the City of Leesburg requires that such fees are to be established from time to time, by the resolution of the City Commission;
NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Leesburg, Florida;

Such amended fees for applications for rezoning, conditional use, annexation, variance, planned unit development, vacating, plat approval, zoning ordinance amendment, comprehensive plan amendment, construction plan approval, preliminary subdivision review, site plan review, D.R.I., lot split, minor subdivision, limited use permit, zoning written verification, tree removal permit, alcohol/beverage license review, traffic study review, historic application review, special event permit, administrative appeal are hereby established and shall be in accordance with said fee schedule attached hereto as Exhibit “A” and entitled, “Schedule of 2008 Amended Fees for Applications to the Planning & Zoning Commission or Board of Adjustment & Appeals of the City of Leesburg”, and are hereby made a part hereof.
THIS RESOLUTION shall become effective upon its passage and adoption according to law, March 1, 2008.
PASSED AND ADOPTED at the regular meeting of the City Commission by the City Commission of the City of Leesburg, Florida, held on the 28th__ day of _January__, 2008.
