Subject: Resolution Adopting the Amended Building Division Fees
Staff Recommendation:
Staff recommends approval of the resolution for the proposed amended fees (Exhibit A).
Background:
The City of Leesburg Commission adopted the current building permit fees by resolution in 2003. There has been a significant increase in development activity and expansion of the City over the last three years. Building Codes have been updated in response to natural disasters, State contractor enforcement regulations have been strengthened to meet public needs, rental housing has increased dramatically in our area and due to annexation our jurisdiction has grown dramatically. Servicing a larger area with a larger population, updated building codes, increased statutory regulation and new city codes addressing rental properties and other issues derived from our growth and progress has increased the costs of running our division. All of these actions have resulted in better development within the City; however, the cost of doing business has increased but the fees to cover those costs have not.
The following summary provides highlights of the recommended draft fee schedule with regard to significant changes to the current city fee schedule. Currently, the City has the lowest building permit fees in the study. Leesburg does not charge plan review fees or contractor registration fees. In addition, other existing fees which are recommended for changes are also shown in the referenced table. The proposed fees represent the average fees for processing comparable applications by local cities and others within the Central Florida area.
Analysis:
The staff’s approach to the analysis was to obtain fee schedules from various cities in or near Lake County similar to Leesburg in size and the services provided. Selected jurisdictions were located in Lake County or in the surrounding counties. Staff selected and reviewed current fees from other municipalities in addition to Leesburg’s fees and developed an Excel spread sheet to compare the fees for each jurisdiction. Also, information was gathered for each jurisdiction indicating their permit charges and fee formulas. Jurisdictions were chosen based on population, size and fee structure. Some jurisdictions were not chosen for the study such as Clermont because they issue permits through the Lake County Building Department and Mascotte and Groveland were not comparable in jurisdiction size or services offered. Fruitland Park’s department was not comparable with ours. In the final analysis, staff looked at the fee structure for the cities of Mount Dora, Eustis, Tavares, Wildwood, Apopka and Ocala. These cities had departments, jurisdictions and services similar to Leesburg. The fees for the selected cities were compared to the fees for the City of Leesburg. Based on the results of this analysis, staff developed a recommended draft fee schedule for review by city administration and consideration by the City Commission. To illustrate the proposed fees, staff developed the attached bar graph and applied the proposed fees to various types of actual projects in the city. The projects compare the current, proposed and average fee from the survey to each project. In addition, fees for the Fire Department were reviewed to assure there was not a duplication of fees with the proposed building fees.
Options:
1. Approve the resolution for the revised fee schedule.
2. Disapprove the resolution for the revised fee schedule.
Fiscal Impact
Approval of the proposed Fee Schedule will increase the revenues generated by the Building Division and offset the cost to process permit applications.

A RESOLUTION OF THE CITY COMMISION OF THE CITY OF LEESBURG, FLORIDA, AMENDING THE BUILDING PERMIT FEE SCHEDULE; REPEALING THE EXISTING BUILDING PERMIT FEE SCHEDULE ADOPTED VIA RESOLUTION NO. 6792; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, certain fees are necessary for processing of permits for Administrative Fees; Commercial Building Permit Fees; Residential Building Permit Fees; Mobile Home Fees; Permit Renewal Fees; Re-Inspection Fees; Sign Permit Fees; Swimming Pool Permit Fees; and Other Permit Fees in conjunction with Chapter 7 of the Code of Ordinances of the City of Leesburg, and
WHEREAS, Article II of Chapter 7 of the Code of Ordinances of the City of Leesburg requires that such fees are to be established from time to time, by the resolution of the City Commission;
NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Leesburg, Florida;
Section 1
That the existing schedule of building permit fees, previously adopted via Resolution No. 6792, is hereby repealed, and that in its place the City Commission does hereby adopt the attached Exhibit A as the schedule of permit fees to be utilized within the City of Leesburg, which includes: Administrative Fees; Commercial Building Permit Fees; Residential Building Permit Fees; Mobile Home Fees; Permit Renewal Fees; Re-Inspection Fees; Sign Permit Fees; Swimming Pool Permit Fees; and Other Permit Fees.
THIS RESOLUTION shall become effective upon its passage and adoption according to law, March 1, 2008.
PASSED AND ADOPTED at the regular meeting of the City Commission by the City Commission of the City of Leesburg, Florida, held on the 28th day of January, 2008.
