Subject:                      Resolution Authorizing Amendment Two extending the Lease Agreement with Paul’s Marine Services to provide Watercraft Repair Services at the Venetian Cove Marina.

Staff Recommendation:     Staff recommends approval of Amendment Two extending the Lease Agreement with Paul’s Marine Services to provide Watercraft Repair Services at the Venetian Cove Marina.

Analysis:

On March 13, 2006, the City Commission approved an agreement with Paul’s Marine Services to provide Watercraft Repair Services at the Venetian Cove Marina for rent of $300 to be paid  monthly to the City of Leesburg.  On February 26, 2007, the City Commission approved extending the agreement for an additional year and increasing the rent to $375 monthly. 

This extension will be the second additional one year term.  Paul’s Marine Services will pay rent of $400 monthly,  plus all applicable sales tax during the term of this contract.  At any time after the first six months of term, the Lessee may request a review of the provisions of this lease and renegotiation of the rental amount by giving the other party thirty days written notice.   If this Lease is extended by written agreement of both parties, the parties will at that time renegotiate the rent, which will increase no more than 25% per year at any time.

Options:

1.  Approve Amendment Two to the Lease Agreement with Paul’s Marine Services or;

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

This agreement will increase revenues for the City of Leesburg of $4,800 for the one year term.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT TWO EXTENDING THE LEASE AGREEMENT  WITH PAUL'S MARINE SERVICES FOR THE PURPOSE OF PROVIDING WATERCRAFT REPAIR SERVICES FOR THE VENETIAN COVE MARINA; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Mayor and City Clerk are hereby authorized to execute Amendment Two extending the Lease Agreement with Paul’s Marine Services whose address is 27620 CR-33, Okahumpka, FL 34762 to provide Watercraft Repair Services for the Venetian Cove Marina.   The Lessee shall pay a monthly rent  of $400 per month.  This amendment is for the second additional one year term and gives the stipulation of a six month review, if the Lessee notifies the Lessor

 THAT this resolution shall become effective immediately.
