Subject:                      Resolution authorizing a Utility Construction Reimbursement (Pioneering) Agreement with the First National Bank of Mount Dora

Staff Recommendation:

Staff recommends approval of a Utility Construction Reimbursement agreement with the First National Bank of Mount Dora.

Analysis:

The First National Bank of Mount Dora constructed a new sanitary lift station and certain other sanitary facilities as part of the development of their site.  At the city’s request, the lift station was designed to accommodate sanitary flows from adjacent properties.  Since The First National Bank of Mount Dora constructed these facilities on behalf of the city, they are entitled to reimbursement of their costs from future connections to the lift station.

This pioneering agreement establishes the maximum reimbursement allowable, the method of calculation of amounts to be collected from future connections, and establishes a term for the agreement.  The City will collect the applicable amounts from future connections and reimburse the bank for the amounts collected, up to the maximum reimbursement allowed.

Options:

1.  Approve the pioneering agreement as presented, or;

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

There is no direct fiscal impact to the city, since the amounts to be reimbursed are collected from future connections.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A UTILITY CONSTRUCTION REIMBURSEMENT (PIONEERING) AGREEMENT WITH THE FIRST NATIONAL BANK OF MOUNT DORA; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Mayor and City Clerk are hereby authorized to execute an agreement  with The First National Bank of Mount Dora whose address is Post Office Box 95, Mount Dora, Florida 32756-0095, for a Utility Construction Reimbursement (Pioneering) Agreement.

 THAT this resolution shall become effective immediately.
