Subject: Resolution authorizing executing an agreement with Mark Cook Builders, Inc. for construction services in the build out of the Leesburg Public Library Café
Staff Recommendation:
Staff recommends approval of the resolution authorizing an agreement with Mark Cook Builders, Inc. for $33,789.00.
Analysis:
The purpose of this project is to contract with a qualified firm to provide construction services to complete the build out of the café area in the Leesburg Public Library.
The completion of the designated café area in the library was not part of the original bid for construction of the library and has been vacant since the library opened last year. The City has an agreement with Z-Coffee of Apopka to operate the café. As soon as the construction is completed, the café operator is ready to begin service.
Staff attempted to negotiate with the library contractor Angle & Schmidt to complete the build out of the café area. They provided a quote of $93,704. Staff felt this amount was excessive for the amount of work to be done. Given the current state of the construction industry, staff felt a much better price could be obtained on the open market using the formal bid process.
On March 24, 2008 the Purchasing Division issued bid number 80231 soliciting qualified and interested firms to submit bids on this project. A mandatory pre-bid meeting was held at which 29 individual firms form Leesburg and Central Florida were represented. On April 14, 2008 10 bid responses were received. The bids were evaluated for completeness and accuracy. The Purchasing Division has identified Mark Cook Builders, Inc. as the lowest responsive and responsible bidder. The architectural plans detail a ceiling soffit to be constructed above the service counter area. Each vendor was requested to submit an additive alternate price for the construction of this soffit. The cost of constructing this soffit is listed separately in the bid tabulation. Staff has deemed the cost of this architectural feature to be too high and have elected not to include it in the contract.
Mark Cook Builders is anxious to begin construction. They have indicated the project could be completed within 45 days of receiving all necessary permits.
Options:
1. Authorized execution of the agreement with Mark Cook Builders, Inc.; or
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
Funding is available in the City Manager’s Contingency line item for this project. Some or all of this funding may be refunded to the CM Contingency from the Library Project if funds are available at close-out of the library project.
The City will begin receiving 5% of pre-tax gross revenues from the café operator three months after the operator opens the café.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH MARK COOK BUILDERS, INC. FOR CONSTRUCTION SERVICES IN THE BUILD OUT OF THE LEESBURG PUBLIC LIBRARY CAFE; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to execute an agreement with MARK COOK BUILDERS, INC., whose address is 511 N. Canal Street, Leesburg, Florida 34748, for construction services in the library café build out pursuant to bid number 80231.
THAT this resolution shall become effective immediately.
