Subject:                      Resolution authorizing an Annexation Agreement with 5^TH Generation

                                    Communities, Inc. (Renaissance Estates)

Staff Recommendation:

Staff recommends approval of the proposed annexation agreement with 5^th Generation Communities, Inc. (Renaissance Estates).

Analysis:

As a result of the proposed annexation of approximately 90 acres of land into the City, an Annexation Agreement has been prepared to address the overall concepts of the development. This Agreement provides:

• That the proposed annexation be given a zoning category of City PUD (Planned Unit Development).
• The developer’s responsibility for the construction and installation of infrastructure related to the improvements of the property.

Options:        

1.         Approve the requested annexation agreement; or,

2.         Other such action as the Commission may deem appropriate.

Fiscal Impact

There is no fiscal impact as a result of this action.

RESOLUTION NO.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING EXECUTION OF AN ANNEXATION AGREEMENT BETWEEN THE CITY OF LEESBURG AND 5^TH GENERATION COMMUNITIES, INC.; AND PROVIDING AN EFFECTIVE DATE. (RENAISSANCE ESTATES)

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

THAT the Mayor and City Clerk of the City of Leesburg are hereby authorized and directed to execute the Annexation Agreement between 5^TH Generation Communities, Inc. and the City of Leesburg, Florida, in the form attached as Exhibit “A” to this resolution.

That this Resolution shall be effective immediately.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 12^th day of May 2008.
