Subject:                       Resolution authorizing the Fourth Amendment to the Memorandum of Understanding with the Villages of Lake and Sumter, Inc. for Airport Customs Services

Staff Recommendation:

Staff recommends approval of the Amendment to the Memorandum of Understanding (MOU) with the Villages of Lake and Sumter, Inc. for Airport Customs Services.

Analysis:

The City originally entered into an agreement with the Villages in July 2003 to provide Customs and Border Protection services at the Leesburg International Airport.  This agreement has evolved to meet the changing needs and situations at the airport. 

At the time of the second amendment to this agreement, there was only one Fixed Base Operator (FBO) doing business at the airport.  It was deemed appropriate to permit this private business to collect the Clearance Fees as a service to their customers.  There is now a second FBO operating at the airport, but they are not permitted under the existing agreement to collect the Clearance Fees.  As such, they are at a competitive disadvantage.  The City has endeavored to maintain a level playing field for both FBOs since Triangle Aviation began doing business as an FBO on the airport. 

Staff believes that it is correct and appropriate to amend the MOU to include Triangle Aviation FBO as an agent to collect the Customs Clearance Fees from their international customers.

Options:

1.  Approve the Amendment to the MOU; or

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

There is no fiscal impact to this action.  The Customs Clearance Fees are reimbursed to the Villages for the use of US Customs Service by customers other than the Villages.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A FOURTH AMENDMENT TO  MEMORANDUM OF UNDERSTANDING BETWEEN THE VILLAGES OF LAKE AND SUMTER, INC., RELATED TO CUSTOMS AND BORDER PROTECTION SERVICES AT LEESBURG INTERNATIONAL AIRPORT; AND PROVIDING AND EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Mayor and City Clerk are hereby authorized to execute a Fourth Amendment to the Memorandum of Understanding  with the Villages of Lake and Sumter, Inc., whose address is 1100 Main Street, The Villages, Florida 32159, for Customs and Border Protection Services at Leesburg International Airport.  A copy of the Agreement is attached.

             THAT this resolution shall become effective immediately.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the    27^th  day of    May   2008.
