SUBJECT: Ordinance correcting a scrivener’s error for Small Scale Comprehensive Plan Amendment, Ordinance 08-43 for Vance Moore-Exclusive Property Group, Inc.
Staff Recommendation
The Planning staff recommends approval of the ordinance correcting a scrivener’s error in Ordinance 08-43, which adopted a Small Scale Comprehensive Plan Amendment to the City’s adopted Growth Management Plan.
Analysis
The purpose of this ordinance is to correct a scrivener’s error for the township number reference in the title of the ordinance from Township 20 South to Township 19 South.
Options
1. Approve the corrective ordinance.
2. Other such action as the Commission may deem appropriate.

There is no fiscal impact to the City.

AN ORDINANCE AMENDING ORDINANCE NO. 08-43, WHICH AMENDED THE COMPREHENSIVE PLAN FOR THE CITY OF LEESBURG, CHANGING THE FUTURE LAND USE MAP DESIGNATION OF CERTAIN PROPERTY CONTAINING APPROXIMATELY 0.44 ACRES AND GENERALLY LOCATED ON THE SOUTH SIDE OF WEST MAIN STREET, JUST EAST OF RICHEY ROAD, LYING IN SECTION 28, TOWNSHIP 19 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA, FROM COUNTY URBAN TO GENERAL COMMERCIAL; IN ORDER TO CORRECT A SCRIVENER’S ERROR IN CITING THE TOWNSHIP NUMBER IN THE TITLE OF THE ORDINANCE; TO APPLY THE CORRECT TOWNSHIP NUMBER AS REFERENCED ABOVE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on May 12, 2008, the City Commission adopted Ordinance No., 08-43 amending the Comprehensive Plan; and
WHEREAS, Ordinance No. 08-43 referred to the township number of the subject parcel inconsistently as 20 and 19 throughout the ordinance and its supporting materials, where only 19 should have been referenced, and
WHEREAS, it is necessary to amend Ordinance No. 08-43, to resolve inconsistency in the township numbers described therein, and
WHEREAS, the City Commission of the City of Leesburg has held public hearings on the proposed amendment to the plan, in light of written comments, proposals and objections from the general public;
NOW, THEREFORE,
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Section 1.
Ordinance No. 08-43 is hereby amended to replace all inconsistent references to the township numbers with a common figure of 19. Except as specifically amended by this Ordinance, it is the intent of the City Commission that Ordinance No. 08-43 shall remain in full force and effect and all of its terms, conditions, and covenants shall apply to the land legally described therein.
Section 2.
All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.
Section 3.
This ordinance shall become effective upon its passage and adoption, according to law.
