SUBJECT: Ordinance for vacating lots 21, 22, 23, 24, 25 and 26, of Majestic Oak Shores subdivision plat for D & E Development, LLC (Dr. Schlein)
Staff Recommendation:
The Planning staff and Planning Commission recommend approval of the request for vacating the referenced lots in Majestic Oak Shores subdivision plat. The area to be vacated will be re-platted by resolution at the City Commission meeting on August 11, 2008 with larger lots to meet market demands.
Analysis:
Vacation of the referenced lots is requested by D & E Development, LLC (Dr. Schlein, owner of the property). This property is generally located along Oak Shores Road, south of Lake Griffin in Section 24-19-24. The lots to be vacated are currently undeveloped. Utility easements shall remain along the adjacent property lines for existing and/or required utility service(s) for these lots.
By a vote of 6 to 0, the Planning Commission recommended approval.
Options:
1. Approve the request to vacate lots 21, 22, 23, 24, 25 and 26 in the referenced subdivision.
2. Other action the Commission may deem appropriate.
Fiscal Impact:
No fiscal impact is anticipated as a result of the vacation of these subdivisions.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, VACATING LOTS 21, 22, 23, 24, 25 AND 26, OF MAJESTIC OAK SHORES SUBDIVISION PLAT IN PLAT BOOK 37, PAGES 50 AND 51, PUBLIC RECORDS OF LAKE COUNTY, FLORIDA, SAID PROPERTY GENERALLY LOCATED ALONG OAK SHORES ROAD, SOUTH OF LAKE GRIFFIN, LYING IN SECTION 24, TOWNSHIP 19 SOUTH, RANGE 24 EAST, LAKE COUNTY, FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Section 1.
The City Commission of the City of Leesburg, Florida, finding that the vacating lots 21, 22, 23, 24, 25 and 26, of Majestic Oak Shores Plat, a subdivision in Lake County, Florida, are not needed for public purposes, therefore the referenced lots for Majestic Oaks Shores Subdivision Plat, legally described below are hereby vacated except as reserved hereinafter:
Legal Description of Lots to be vacated:
Lots 21, 22, 23, 24, 25, 26, and 27 of Majestic Oaks Shores Subdivision, a partial replat of Jamestowne, Plat Book 37, Pages 50 & 51, and a Subdivision in the City of Leesburg, in Section 24, Township 19 South, range 24 East, Lake County Florida.
Section 2.
The City Commission specifically reserves in perpetuity, for the use and benefit of the City of Leesburg, utility easements for any areas where there are utility lines (above ground or underground) now in existence on the property, as well as utility easements over and across any and all roads, streets and alleys otherwise vacated by this Ordinance.
Section 3.
This ordinance shall become effective upon its passage and adoption according to law.
PASSED AND ADOPTED at the regular meeting of the City Commission of the City of Leesburg, Florida, held on the ______ day of ______________, 2008.
