Subject: Resolution authorizing executing an agreement with Pospiech Contracting, Inc. for construction services for the Venetian Gardens Stormwater project
Staff Recommendation:
Staff recommends approval of the resolution authorizing an agreement with Pospiech Contracting, Inc. for $32,000.00.
Analysis:
The purpose of this project is to contract with a qualified firm to provide construction services for improvements to the stormwater runoff into Lake Griffin. This project will reduce the amount of solids that are allowed to reach the lake.
The contractor will install new drainage pipes to re-route flow from a downtown Leesburg drainage basin to a new stormwater treatment structure. The stormwater treatment structure will be located on City owned property. Discharge from the structure will be directed through a new manhole and pipes to the Venetian Gardens canals. The stormwater treatment structure is a second generation baffle box that will be delivered to the site and placed in position by the manufacturer.
Work on this grant funded project must be completed by September 15, 2008. The purchasing division placed this project on an expedited bid process. Invitation to Bid (ITB) 80361 was issued on June 30, 2008. The ITB was sent directly to seven contractors capable of providing this service. On July 14, 2008 the Purchasing Division received two responses to the ITB. The responding contractors and their prices for the project are listed below.

The total amount of this project is $195,610, to date, $132,521 (not including purchase requisition 39784 included on this agenda) has been spent. These expenses include $63,621 for engineering services and $68,900 for construction services and materials. Total project funding is as follows: City of Leesburg $79,000; Federal Environmental Protection Agency grants $72,366; and the Saint Johns River Water Management District $44,244.
Options:
1. Authorize execution of the agreement with Pospiech Contracting, Inc.; or
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
The funds for this portion of the project are budgeted and available. Any amounts above the City contribution of $79,000 will be reimbursed by the granting agencies previously listed.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH POSPIECH CONTRACTING, INC. FOR CONSTRUCTION SERVICES RELATED TO STORMWATER RUNOFF INTO LAKE GRIFFIN; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to execute an agreement with POSPIECH CONTRACTING, INC. whose address is 201 East Apopka Avenue, Inverness, Florida 34452 for construction services to upgrade a section of storm water section that discharges into Lake Griffin pursuant to invitation to bid 80361.
THAT this resolution shall become effective immediately.
