SUBJECT: Resolution to Transmit School Concurrency Items to Florida Department of Community Affairs (DCA)
Staff Recommendation:
The Planning staff and Planning Commission recommend transmittal of items necessary for implementation of school concurrency to the Florida Department of Community Affairs (DCA), including text amendments to the Comprehensive Plan, as well as a certified copy of the First Amended Interlocal Agreement (adopted via Resolution No. 8147).
Analysis:
The text amendments to the Comprehensive Plan are required by a state mandate for all local governments to implement school concurrency this year. These amendments include the addition of a Public Schools Facilities Element to the City’s Comprehensive Plan, as well as the revision of the Capital Improvements Element to adopt by reference the Lake County Schools Five Year Facilities Master Plan Capital Improvement Program, Fiscal Years 2008-2012.
The amendments are based on model documents prepared by the City of Mount Dora, which was the first city in Lake County to begin the compliance process for school concurrency with the Florida Department of Community Affairs (DCA). The City of Mount Dora is presently nearing a settlement agreement with DCA, which has allowed the remaining cities to proceed with the transmittal process with some degree of certainty.
Options:
1. Approve the transmittal of the school concurrency items described above to DCA.
2. Other such action as the Commission may deem appropriate.
Fiscal Impact:
There is no direct fiscal impact to the City.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE TRANSMITTAL OF ITEMS NECESSARY FOR IMPLEMENTATION OF SCHOOL CONCURRENCY TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS (DCA), INCLUDING TEXT AMENDMENTS TO THE COMPREHENSIVE PLAN, AS WELL AS A CERTIFIED COPY OF THE FIRST AMENDED INTERLOCAL AGREEMENT (ADOPTED VIA RESOLUTION NO. 8147); AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the City of Leesburg, Florida, hereby approves the transmittal of items necessary for implementation of school concurrency to the Florida Department of Community Affairs (DCA), including text amendments adding a Public Schools Facilities Element and revising the Capital Improvements Element in the Comprehensive Plan, as well as a certified copy of the First Amended Interlocal Agreement (adopted via Resolution No. 8147).
THAT this resolution shall become effective immediately.
PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida at a regular meeting held on the 11th day of August, 2008.
