Subject:                      Resolution Authorizing Amendment One extending the Lease Agreement    with Derek Schoening d/b/a Lake Marine to provide Watercraft Repair  Services at Venetian Cove Marina

Staff Recommendation:

Staff recommends approval of Amendment One extending the Lease Agreement with Derek Schoening d/b/a Lake Marine to provide watercraft repair services at Leesburg Venetian Cove Marina.

Analysis:

On March 24, 2008, the City Commission approved a Lease Agreement with Derek Schoening d/b/a Lake Marine to provide watercraft repair services at the Venetian Cove Marina effective April 1, 2008. 

Since his initial Lease Agreement, Derek Schoening has provided quality watercraft repair services and has established a rapport with many of the Marina patrons. 

Derek Schoening will pay rent of $400 monthly to the City of Leesburg, plus all applicable sales tax during the one year term of this contract.  Renegotiation of the rent was not requested at this time since the initial agreement with Derek Schoening d/b/a/ Lake Marine was a six month term expiring September 30, 2008 and this extension will coincide with the City of Leesburg’s fiscal year.

All other terms and conditions are described within the attached agreement.

Options:

1.  Approve Amendment One extending the Lease Agreement with Derek Schoening  d/b/a Lake

     Marine or:

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

This agreement will increase revenues for the City of Leesburg of $4,800 for the one year term.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT ONE EXTENDING THE LEASE AGREEMENT WITH DEREK SCHOENING D/B/A LAKE MARINE TO SEPTEMBER 30, 2009, FOR THE PURPOSE OF PROVIDING WATERCRAFT REPAIR SERVICES FOR THE VENETIAN COVE MARINA: AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

            THAT the Mayor and City Clerk are hereby authorized to execute Amendment One extending the Lease Agreement with Derek Shoening d/b/a Lake Marine whose address is 2613 Icabod Court, Leesburg, Florida, 34748 for the purpose of providing watercraft repair services for the Venetian Cove Marina.  The Lessee shall pay monthly rent of $400. This extension is a one year term unless earlier terminated in accordance with the terms of this Lease.

 THAT this resolution shall become effective immediately.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the __25th_ day of _August_ 2008.
