SUBJECT: Ordinance for rezoning for Frederick W. Froelich, et al property
Staff Recommendation:
The Planning staff and Planning Commission recommend approval of the proposed rezoning for the subject property from City P (Public) to RE-1 (Estate Density Residential).
Analysis:
The project site is approximately 8.72 acres. The property is generally located south of Highway 441 east of Sleepy Hollow Road, as shown on the attached General Location Map. The present zoning for this property is City R-2 (Medium Density Residential). Currently, the property is undeveloped, and the proposed use is undetermined at this time. The surrounding zoning designations are County R-1 (Rural Residential) to the north and City P (Public) to the south, east and west.
The proposed zoning district of RE-1 (Estate Density Residential) is compatible with adjacent and nearby properties in the area and with the proposed City future land use designation of Estate Density Residential.
The existing land uses surrounding the property are commercial/light industrial, undeveloped and Lake Harris.
City utilities are currently connected to the property.
By a vote of 6 to 0, the Planning Commission voted to recommend approval.
Options:
1. Approve the proposed rezoning to RE-1 (Estate Density Residential), thereby allowing consistent zoning and development standards for the area; or
2. Other such action as the Commission may deem appropriate.
Fiscal Impact:
There will be a positive fiscal impact to the City when the property is developed.

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, REZONING APPROXIMATELY 8.72 ACRES GENERALLY LOCATED SOUTH OF HIGHWAY 441 EAST OF SLEEPY HOLLOW ROAD, LYING IN SECTION 20, TOWNSHIP 19 SOUTH, RANGE 25 EAST, LAKE COUNTY, FLORIDA, FROM CITY P (PUBLIC) TO RE-1 (ESTATE DENSITY RESIDENTIAL), AND PROVIDING AN EFFECTIVE DATE (FREDERICK W. FROELICH, ET AL).
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Section 1.
Based upon the petition of Frederick W. Froelich, et al, the owner of the property hereinafter described, which petition has heretofore been approved by the City Commission of the City of Leesburg Florida, pursuant to the provisions of the Laws of Florida, the said property located in Lake County, Florida, is hereby rezoned from City P (Public) to RE-1 (Estate Density Residential) zoning district, as legally described in Exhibit A, to-wit:

This ordinance shall become effective upon its passage and adoption, according to law.

Begin at the Southwest corner of the Northwest ¼ of the Northwest ¼ of Section 21, Township 19 South, Range 25 East in Lake County, Florida, and run S.89°42’30”E. along the South line of the Northwest ¼ of the Northwest ¼ a distance of 100.00 feet, more or less, to a point on the Westerly mean-high water line of a canal; thence Southwesterly, Westerly and Northwesterly along and with said mean-high water line of a canal to a point on the South line of the Northeast ¼ of the Northeast ¼ of Section 20, Township 19 South, Range 25 East in Lake County, Florida; thence S89°42’30”E. along the South line of the Northeast ¼ of the Northeast ¼ a distance of 811.00 feet, more or less, to the Point of Beginning.
