SUBJECT: Resolution to Amend Planning and Zoning Fees to Include a Filing Fee for the License Agreements and for the new SPUD (Small Planned Unit Development) District
Staff Recommendation
Staff recommends approval of the amendments to the 2008 Amended Fees, adopted by Resolution No. 8114, and amended by Resolution No. 8216, to include a fee for License Agreements and for the new SPUD (Small Planned Unit Development) District.
Analysis
Since the adoption of the 2008 Amended Fees, staff has determined that an additional fee for license agreements used for such activities as side walk cafes and a new revised fee for SPUD’s need to be incorporated in the adopted fee schedule. A proposed fee of $7.00 sq, ft./minimum $100 is recommended for License Agreements and a fee of $1,200 is recommended for SPUD’s with a fee of $850 for SPUD amendments. These recommended fees are comparable to the existing fees established under the current adopted fee schedule.
Options
1. Approve the Resolution for the amendment to the 2008 Amended Fees; or
2. Other such action as the Commission may deem appropriate.
Fiscal Impact
Approval of the amendments to the 2008 Amended Fees schedule to include the referenced fees will allow the City to recover the associated costs for processing these activities.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, ADOPTING AN AMENDMENT TO THE 2008 AMENDED FEES, ADOPTED VIA RESOLUTION NO. 8114, AS AMENDED BY RESOLUTION NO. 8216 TO INCLUDE A FEE OF $7.00 SQ. FT./MINIMUM $100 FOR LICENSE AGREEMENTS AND A FEE OF $1,200 FOR SPUD APPLICATIONS AND A FEE OF $850 FOR SPUD AMENDMENTS; DELETING FEES FOR THE CIP DISTRICT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Article VIII of Chapter 25 of the Code of Ordinances of the City of Leesburg requires that certain fees are necessary for processing of applications and that such fees are to be established from time to time, by the resolution of the City Commission;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the 2008 Amended Fees schedule, adopted via Resolution No. 8114, as amended by Resolution No. 8216, be amended to include a fee of $7.00 sq. ft./minimum $100 for license agreements and a fee of $1,200 for SPUD applications with a fee of $850 for SPUD amendments and deletion of fees for the CIP district.
THAT this resolution shall become effective immediately.
PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida at a regular meeting held on the 8th day of September, 2008.
