SUBJECT:                  Resolution resetting tentatively the public hearing date of March 23, 2009, to February 23, 2009 for adoption of the Secret Promise DRI Development Order

Staff Recommendation

Staff recommends that the City Commission tentatively reset the public hearing date for the adoption of the DRI Development Order from March 23, 2009 to February 23, 2009 for the Secret Promise DRI.

Analysis

The applicant for the Secret Promise DRI per Chapter 380.06 F.S has requested the Leesburg City Commission reset the public hearing date at the September 22, 2008 City Commission hearing, and that the public hearing date for the adoption of the DRI Development Order be reset from March 23, 2009 to February 23, 2009. This is necessary due to additional information from the applicant’s attorney that was not available at the last City Commission meeting. This date is tentative and may need to be rescheduled if there are delays at DCA or RPC in reviewing the DRI.

Options         

1.         Approve the Resolution for tentatively resetting the public hearing date for the adoption of the DRI Development Order for February 23, 2009 for Secret Promise DRI per Chapter 380.06 F.S.;  or

2.         Other such action as the Commission may deem appropriate.

Fiscal Impact

Resetting the public hearing date for the adoption of the DRI Development Order will not have any fiscal impact on the City of Leesburg. The actual DRI Development Order will address fiscal impacts.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, RESETTING TENTATIVELY THE PUBLIC HEARING DATE FOR FEBRUARY 23, 2009 FOR ADOPTION OF THE SECRET PROMISE DRI DEVELOPMENT ORDER; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Chapter 380.06, F.S requires that the City Commission of the City of Leesburg, Florida, set the public hearing date for the adoption of the DRI Development Order for the Secret Promise DRI;

WHEREAS, the City Commission of the City of Leesburg, Florida, set the public hearing date for the adoption of the DRI Development Order for the Secret Promise DRI for March 23, 2009;

WHEREAS, the applicant’s attorney has requested that City Commission of the City of Leesburg, Florida, reset the public hearing date for the adoption of the DRI Development Order for the Secret Promise DRI from March 23, 2009 to February 23, 2009;

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

THAT the City Commission does reset tentatively the public hearing date for adoption of the DRI Development Order for February 23, 2009 for Secret Promise DRI.

THAT this resolution shall become effective immediately.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida at a regular meeting held on the 22^nd day of September, 2008.
