Subject:                      Resolution releasing the assessments on the Shore Acres Drive Water and Fire Improvements

Staff Recommendation:

Staff recommends approval of the resolution noting collection of all payments for the final assessment costs and recording the resolution stating all assessments due in connection with the project are satisfied in full.

Analysis:

The City of Leesburg Commission adopted Resolution 4780 July 11, 1994, authorizing the final assessment costs for water and fire improvements for Shore Acres Drive.  Each property owner affected by the improvements was assessed as outlined in Resolution 4780.  The assessments were payable within seven years and accrued interested at 6%.    The last payment was made in December of 2007.

Options:

1.  Adopt the resolution approving recording stating all assessments have been satisfied in full; or

2.  Such alternative action as the Commission may deem appropriate

Fiscal Impact: 

The recording fee of $10.00 is the only fiscal impact to record this ordinance.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, FINALIZING THE WATER AND FIRE IMPROVEMENTS FOR SHORE ACRES DRIVE AS AUTHORIZED BY RESOLUTION 4671 AND HEREBY NOTING THE COLLECTION OF ALL PAYMENTS FOR THE FINAL ASSESSMENT COSTS AS AUTHORIZED BY RESOLUTION 4780; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA that:

Section 1.

            The project initiated by Resolution No. 4671 has been completed and all assessments authorized by Resolution No. 4780 recorded in Lake County, Florida on November 3, 1994, O.R. Book 1327, Pages 1197-1200, have been collected as of December 17, 2007.  All liens held or claimed by the City to secure assessments due in connection with the project are released and satisfied in full.

Section 2.

            All resolutions or parts thereof in conflict herewith are superseded to the extent of such conflict.

THAT this resolution shall become effective immediately.
