The Planning staff and Planning Commission recommend approval of the proposed rezoning for the subject property from County C-2 (Community Commercial) to City C-3 (Highway Commercial).
The project site is approximately 1.34 acres. The property is generally located on the south side of C.R. 441 at the intersection of C.R. 44 and Sleepy Hollow Road as shown on the attached General Location Map. The present zoning for this property is County C-2 (Community Commercial). Currently, the property is a closed convenience store with gas pumps, and the proposed use is vehicle sales. The surrounding zoning designations are Lake County RMRP (Residential Mobile Rental Park) to the north, C-3 (Highway Commercial) and P (Public) to the east, R-2 (Medium Density Residential) and R-3(High Density Residential) to the south, and C-3 (Highway Commercial) to the west.
The proposed zoning district of City C-3 (Highway Commercial) is compatible with adjacent and nearby properties in the area and with the proposed City future land use designation of General Commercial.
The existing land uses surrounding the property are commercial and undeveloped properties.
Development of the parcel shall require connection to City utilities at the owner’s expense.
By a vote of 6 to 0, the Planning Commission voted to recommend approval.
1. Approve the proposed rezoning to C-3 (Highway Commercial), thereby allowing consistent zoning and development standards for the area.
2. Other such action as the Commission may deem appropriate.
There is no fiscal impact to the City with this application

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, REZONING APPROXIMATELY 1.34 ACRES GENERALLY LOCATED at THE INTERSECTION OF US HIGHWAY 441, SLEEPY HOLLOW ROAD, AND COUNTY ROAD 44, LYING IN SECTION 20, TOWNSHIP 19 SOUTH, RANGE 25 EAST, LAKE COUNTY, FLORIDA, FROM COUNTY C-2 (COMMUNITY COMMERCIAL) TO CITY C-3 (HIGHWAY COMMERCIAL), AND PROVIDING AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
Based upon the petition of Lee Hess, Inc., the owner of the property hereinafter described, which petition has heretofore been approved by the City Commission of the City of Leesburg Florida, pursuant to the provisions of the Laws of Florida, the said property located in Lake County, Florida, is hereby rezoned from County C-2 (Community Commercial) to City C-3 (Highway Commercial) zoning district, as legally described in Exhibit A, to-wit:
