SUBJECT:                  Resolution authorizing transmittal of the Response to the Objections, Recommendations, and Comments (ORC) Report (DCA Amendment No. 08-PEFE1) Regarding the Adoption of School Concurrency Text Amendments to the Comprehensive Plan

Staff Recommendation: 

The Planning staff recommends transmittal of the response to the Objections, Recommendations, and Comments (ORC) Report received from the Florida Department of Community Affairs (DCA) on November 7, 2008 including amendments.

Analysis:

The text amendments to the Comprehensive Plan are required by a state mandate for all local governments to implement school concurrency this year. These amendments include to the Capital Improvements Element, the Intergovernmental Coordination Element, and the adoption of a new Public Schools Facilities Element.

A Response to the ORC Report has been drafted for transmittal, based largely on a similar ORC Response by the City of Groveland, which resulted in a finding of “In Compliance” by DCA for that City.  The text amendments to the Capital Improvements Element and the Intergovernmental Coordination Element were also revised to address Objections by DCA.  By following the precedent set by other cities, the City of Leesburg has made a concerted effort to comply with DCA’s requirements.

Options:        

1.         Approve transmittal of the response to the Objections, Recommendations, and Comments (ORC) Report for school concurrency items described above to DCA.

2.         Other such action as the Commission may deem appropriate.

Fiscal Impact:

There is no direct fiscal impact to the City.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, AUTHORIZING THE TRANSMITTAL OF THE RESPONSE TO THE OBJECTIONS, RECOMMENDATIONS, AND COMMENTS (ORC) REPORT (DCA AMENDMENT NO. 08-PEFE1) REGARDING THE ADOPTION OF SCHOOL CONCURRENCY TEXT AMENDMENTS TO THE COMPREHENSIVE PLAN, RECEIVED FROM THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS (DCA), BY THE CITY OF LEESBURG COMMUNITY DEVELOPMENT DEPARTMENT; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

THAT the City of Leesburg, Florida, hereby approves the response to the Objections, Recommendations, and Comments (ORC) Report received from DCA on November 7, 2008, and directs that this response be transmitted to DCA, along with the adopted School Concurrency text amendments to the Comprehensive Plan, which include amendments to the Capital Improvements Element, the Intergovernmental Coordination Element, and the adoption of a new Public Schools Facilities Element, as required by state mandate.

THAT this resolution shall become effective immediately.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida at a regular meeting held on the 22^nd day of December, 2008.
