The Planning staff and Planning Commission recommend approval of the proposed School Concurrency Text Amendments to the Comprehensive Plan, which include amendments to the Capital Improvements Element, the Intergovernmental Coordination Element, and the adoption of a new Public Schools Facilities Element, as required by state mandate.
The text amendments to the Comprehensive Plan are required by a state mandate for all local governments to implement school concurrency. The proposed Public Schools Facilities Element is based on a model prepared by the City of Mount Dora, which was the first city in Lake County to begin the compliance process for school concurrency with the Florida Department of Community Affairs (DCA). This Element and related amendments were approved by the Leesburg City Commission for transmittal to the Florida Department of Community Affairs (DCA) on August 11, 2008.
The Objections, Recommendations, and Comments (ORC) Report was received by the City from DCA on November 7, 2008 (DCA Amendment No. 08-PEFE1). A Response to the ORC Report has been drafted for transmittal, based largely on a similar ORC Response by the City of Groveland, which resulted in a finding of “In Compliance” by DCA for that City. The text amendments to the Capital Improvements Element and the Intergovernmental Coordination Element were also revised to address Objections by DCA. By following the precedent set by other cities, the City of Leesburg has made a concerted effort to comply with DCA’s requirements.
The Planning Commission held a public hearing on the School Concurrency text amendments on July 24, 2008 and by a vote of 6 to 0, recommended approval.
1. Approve the proposed School Concurrency Text Amendments to the Comprehensive Plan.
2. Other such action as the Commission may deem appropriate.
There is no direct fiscal impact to the City.

AN ORDINANCE OF THE CITY OF LEESBURG, FLORIDA, AMENDING THE CITY’S COMPREHENSIVE PLAN; ADDING OR ADOPTING REVISIONS TO THE PUBLIC SCHOOLS FACILITIES ELEMENT, CAPITAL IMPROVEMENTS ELEMENT, AND INTERGOVERNMENTAL COORDINATION ELEMENT; ADOPTING AMENDMENTS TO THE COMPREHENSIVE PLAN ARISING FROM THE REQUIRED IMPLEMENTATION OF SCHOOL CONCURRENCY BY STATE MANDATE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Leesburg has held public hearings on the proposed School Concurrency text amendments to the Comprehensive Plan;
WHEREAS, the City of Leesburg has drafted a response to the Objections, Recommendations, and Comments (ORC) Report received from the Department of Community Affairs and has made the necessary revisions to the amendments; and
BE IT ENACTED BY THE PEOPLE OF THE CITY OF LEESBURG, FLORIDA, that:
The City Commission of the City of Leesburg, Florida hereby adopts the Public Schools Facilities Element, as well as related amendments to the Capital Improvements Element and Intergovernmental Coordination Element of the Comprehensive Plan, in the form attached as Exhibit “A” hereto. Upon final adoption of this Ordinance on second reading, the amendments shall become a part of the Comprehensive Plan for all purposes attendant thereto.
All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.
This ordinance shall become effective upon its passage and adoption, according to law.
