Subject: Resolution Authorizing an Agreement with the Florida Winter Baseball League, Inc., to Lease Pat Thomas Stadium for a professional winter baseball league
Staff Recommendation:
Staff recommends authorizing an agreement with the Florida Winter Baseball League, Inc to lease Pat Thomas Stadium together with the locker rooms, designated business area and parking areas for a professional winter baseball league.
Analysis:
The Florida Winter Baseball League, Inc, representatives James Gamble and Kevin Davidson, contacted staff regarding leasing Pat Thomas Stadium for the 2009 winter baseball league. This is a professional, independent minor league specifically for winter baseball.
The term of this agreement will begin October 1, 2009 and shall expire January 31, 2010. There will be a total of thirty home games during this period. This agreement may be renewed annually under similar terms and conditions at the City’s sole discretion, provided the League gives sixty days notice to the City of its desire to renew prior to the expiration of this agreement.
The League for the use of Pat Thomas Stadium, and the revenue earned pursuant to this agreement, agrees to:
a) Pay the City a $5,000 nonrefundable signing fee at the time of signing this agreement.
b) Pay the City a $5,000 refundable security/damage deposit at least sixty days prior to the League’s first event.
c) Pay the City an additional $10,000 in 2009 in two equal installments. Payments shall be made on or before July 15 and September 15. All field maintenance costs are included in the $15,000 total lease fee.
d) Pay all utility bills associated with use of the Stadium during the term of this lease.
e) Provide a baseball clinic for youth during the term of the contract at Pat Thomas Stadium as a league event and co-sponsor one City event with the Parks & Recreation Department.
Options:
1. Approve Agreement with Florida Winter Baseball League, Inc, to Lease Pat Thomas Stadium or;
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
This lease commences October 1, 2009. The funds will be held in an escrow account until the league begins the season in October 2009.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE A LEASE AGREEMENT WITH THE FLORIDA WINTER BASEBALL LEAGUE, INC., TO LEASE PAT THOMAS STADIUM FOR A PROFESSIONAL WINTER BASEBALL LEAGUE; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to execute an agreement with Florida Winter Baseball League, Inc. whose address is 5100 Blue Lagoon Drive, Suite 885, Miami, Florida 33126 for the purpose of leasing Pat Thomas Stadium together with the locker rooms, designated business area, and parking areas. The term of this agreement shall begin October 1, 2009 and shall expire on January 31, 2010. The league shall pay to the City $15,000, plus utilities, for usage of Pat Thomas Stadium.
THAT this resolution shall become effective immediately.
