Subject: Resolution authorizing Change Order Number 1 with James P. Senatore, Architect
Staff Recommendation:
Staff recommends approval of change order number 1 to an existing agreement with James P. Senatore, Architect for $6,000.00.
Analysis:
James Senatore has an existing agreement to provide professional architect services related to the Kristen Court rehabilitation project. This change order will authorize additional services and increase the existing agreement from $32,000 to $38,000.
Developing the units as condominiums or townhouses has been a point of contention since the start of this project. The original agreement with Senatore was to design the units as condominiums. This may seem a minor point, to most just a name. However, designating the units as condominiums or townhouses creates different requirements in the design to meet building code. The designation of the units has further ramifications during the sales process and more importantly after the sale and how they are managed going forward.
Staff has consulted with planners, outside legal counsel, and our own City Attorney. Staff decided in order to provide for the best success on this project after the sale, the units should be designed, marketed, and sold as “Townhomes.” This designation requires additional fire separation on the units. This change order authorizes the additional expense for Senatore to update existing plans with the required firewall and update the additional detailed floor plan options.
Both our City Attorney and outside legal counsel familiar with real estate development have recommended the units be developed and sold as townhomes. Condominiums will require more upfront expenses by the City and increased government regulation from the state. Post sale management of the condominiums by the owners association would be much more involved. Townhomes are less complicated to develop, sell, and manage after the sale by the owners association. Townhomes will require a simple Home Owners Association similar to those common in subdivisions of detached homes.
Options:
1. Approve change order number 1 to the agreement with James P. Senatore, Architect; or
2. Such alternative action as the Commission may deem appropriate
Fiscal Impact:
Funds are available for this additional expense.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE CHANGE ORDER NUMBER 1 TO AN EXISTING AGREEMENT WITH JAMES SENATORE, ARCHITECT FOR ADDITIONAL DESIGN SERVICES RELATED TO CHANGING KRISTEN COURT FROM CONDOMINIUM TO TOWNHOME DESIGNATION AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to execute change order number one with JAMES P. SENATORE, ARCHITECT whose address is 1317 Sumter Street, Leesburg, Florida 34748 for additional design services related to changing the Kristen Court project from condominium to townhome designation for development and sale.
THAT this resolution shall become effective immediately.
