Subject:                      Resolution adopting the Florida Municipal Power Agency All-Requirements            

                                    Net Metering Policy, the Standard Interconnection Agreement for Customer-

                                    Owned Renewable Electric Generation System, and related documents

 

Staff Recommendation:

Staff recommends the City of Leesburg adopt the Florida Municipal Power Agency (FMPA) All-Requirements Project Net Metering Policy approved by the FMPA Board of Directors.  Staff further recommends that certain Agreements and other documents necessary for implementation of the Net Metering Policy and Standard Interconnection Agreement be adopted for use by the City of Leesburg. 

 

Analysis:

Under the provisions of Section 366.91, Florida Statutes, and Rule 25-6.065, Florida Administrative Code, the Florida Public Service Commission requires that Municipal Electric utilities must file a copy of their Standard Interconnection Agreement by June 1, 2009 and report certain information related to customer-owned renewable generation interconnections by April 1 of each year.  The City of Leesburg has one retail customer with an installed customer-owned renewable generation system that was connected October 1, 2008.  This customer is currently receiving electric service under the terms of draft documents essentially equivalent to the documents now proposed for consideration and adoption by the City Commission.

 

Options:

1. Adopt the proposed Net Metering Policy, Standard Interconnection Agreement, and related documents

2.  Such alternative action as the Commission may deem appropriate

Cost per location: Approximately $300.00 for metering and monthly manual account review by staff

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA, ADOPTING THE FLORIDA MUNICIPAL POWER AGENCY ALL-REQUIREMENTS PROJECT NET METERING POLICY AND STANDARD INTERCONNECTION AGREEMENT FOR CUSTOMER-OWNED RENEWABLE ELECTRIC GENERATION; AND PROVIDING AN EFFECTIVE DATE.

 

           

WHEREAS, the City Commission of the City of Leesburg held a Public Hearing on October 22, 2007, during which City of Leesburg electric utility staff presented facts and recommendations regarding the then new Public Utility Regulatory Policies Act (“PURPA”) standards included in the Energy Policy Act of 2005 including net metering and interconnection standards for distributed resources, among other recommendations, and

 

            WHEREAS, the City Commission of the City of Leesburg, Florida conducted independent proceedings to consider the new standards; and made a determination that it was not in the best interest of the electric customers to adopt the PURPA Standards at that time; and further noted that City staff would continue to work with FMEA and FMPA to draft a workable solution to net metering that would not violate the All Requirements Project Contract as well as work with FMEA and FMPA to develop an interconnection agreement in conjunction with the FPSC’s rulemaking process, and

 

             WHEREAS, City staff, FMEA and FMPA have now developed appropriate Net Metering and Interconnection Standards meeting the needs of each entity.

 

             NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Leesburg, Florida that certain Agreements and other documents necessary for implementation of the Net Metering Policy and Standard Interconnection Agreement be adopted as follows:

           

1.      Florida Municipal Power Agency All-Requirements Project Net Metering Policy

2.      Appendix A – Tri-Party Net Metering Power Purchase Agreement

3.      Appendix B – All-Requirements Project Calculation of Customer-Owned Renewable Generation Credit

4.      Standard Interconnection Agreement for Customer-Owned Renewable Generation System

5.      Exhibit A – Application for Interconnection of Customer-Owned Renewable Generation System

6.      Tariff Sheet N-1 Net Metering Service

 


 

THAT this resolution shall become effective immediately.

 

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held on the 26th day of May, 2009.
