Subject:                      Resolution to Grant Easement from City of Leesburg, Florida to The Plantation Residents Golf Club, Inc. for property located in Section 23, Township 20 South, Range 24 East, Lake County, Florida

 

 

Staff Recommendation:

Staff recommends granting of easement to The Plantation Residents Golf Club, Inc. (The Plantation) for property located in Section 23, Township 20 South, Range 24 East, Lake County, Florida.

 

Analysis:

The proposed easement area consists of a retention pond which receives reclaimed water from a wastewater treatment plant owned and operated by the City of Leesburg (The City), out of which The Plantation currently pumps water to irrigate its golf course.  The City plans to discontinue use of the wastewater treatment plant and to supply The Plantation with treated wastewater for irrigation from another of its wastewater treatment plants, charging The Plantation the applicable rate for treated wastewater.  This easement is for the sole purpose of on site storage of treated wastewater supply by The City and for no other purpose whatsoever.  This easement shall terminate immediately if The Plantation ceases to be a customer of The City for the purpose of purchasing treated wastewater for irrigation purposes.

 

Options:

1.  Approve the granting of easement to The Plantation Residents Golf Club, Inc., or,

2.  Such alternative action as the Commission may deem appropriate

 

Fiscal Impact: 

The City will incur no costs due to the granting of this easement.

A resolution of the City Commission of the City of Leesburg, Florida, authorizing the Mayor and City Clerk to execute an Easement from the City of Leesburg, Florida to The Plantation Residents Golf Club, Inc. for property located in Section 23, Township 20 South, Range 24 East, Lake County, Florida; and providing an effective date.

 

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

 

            THAT the Mayor and City Clerk are hereby authorized to execute an easement  to The Plantation Residents Golf Club, Inc. whose address is 4720 Plantation Blvd., Leesburg, Florida 34748.

 

             THAT this resolution shall become effective immediately.

 

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the 22nd day of June, 2009.
