Staff recommends termination of the Joint Partnership Agreement for landscaping improvements on US 441 (West of College Road to Mills Street).
December 21, 2006, the City Commission approved the Joint Partnership Agreement (JPA) between the City of Leesburg and State of Florida, Department of Transportation (FDOT) for phase II of the landscaping improvements on SR 500/US 441 between Mills Street and West of College Road.
FDOT is requesting the status of this project in order to provide information for the quarterly report that is sent to the Governor. This project has been dormant for approximately twenty four months with no expenditures applied. Due to the declining economy and 2007’s tax reform, the City has not been in a position to install the improvements and begin maintenance of same. Although funds for the balance of the installation could possibly be found within the 27/441 CRA, funding for maintenance is not available from any source.
The best possible future source of funding would be the establishment of a Business Improvement District (BID) encompassing the properties fronting Hwy 441 where the improvements will be made. The district would assess the benefitting properties for the annual maintenance of the landscaping. Unfortunately current economic conditions are not conducive to the establishment of such a district and the resulting increase in taxes paid by those businesses. While spreading the cost of maintenance over so many parcels means that the impact to individual businesses would be somewhat nominal, staff believes that proposing ANY additional assessment at this time would be poorly received.
Due to the above constraints, staff recommends the JPA with FDOT be terminated with the option to reapply in the future.
1. Approve resolution authorizing the termination of the JPA or;
2. Such alternative action as the Commission may deem appropriate
The JPA will pay the City $805,000 for beautification of SR 441; however, the installation needs to be fully completed and approved by FDOT prior to receiving funds. Furthermore, the JPA can only apply towards expenses for the actual installation of plant material. The entire project including design, installation, and irrigation was estimated to cost $1.2 million. At this time, the City does not have the funds to proceed with the beautification project, much less complete it to the satisfaction of FDOT for reimbursement by the JPA funding of $805,000.
To date $95,899 has been paid for landscape design, of which $35,665 was spent in FY 08-09 and the remainder spent in prior years. A budget adjustment will be processed to decrease the funding in the Capital Projects fund for this project.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO TERMINATE THE JOINT PARTNERSHIP AGREEMENT BETWEEN THE CITY OF LEESBURG AND THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION FOR PHASE II OF THE LANDSCAPING IMPROVEMENT PROJECT ON SR 500/US 441 BETWEEN MILLS STREET AND WEST OF COLLEGE ROAD; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:
THAT the Mayor and City Clerk are hereby authorized to terminate the Joint Partnership Agreement with the State of Florida, Department of Transportation for the purpose of phase II of the landscaping improvement beautification project on SR 500/US 441 between Mills Street and West of College Road.
THAT this resolution shall become effective immediately.
